Our client worked for a federal contractor at the Naval Airforce Welfare Center in Maryland. He filed an EEO complaint for religious discrimination against the Navy after his coworkers mocked his prayer beads and black clothing during Holy Week. The agency dismissed the complaint because our client was not a federal employee. We appealed the dismissal to the Office of Federal Operations, arguing that the Navy controlled our client’s work and was his joint employer. The OFO agreed with our arguments and ordered the Navy to process and investigate our client’s complaint.
