The agency proposed to remove our client after she received a negative suitability determination. The agency alleged that our client had engaged in misconduct and/or negligence in employment and dishonest conduct relating to her disclosures in her job application. We submitted a written response demonstrating that our client provided honest disclosures and that many of the cited incidents were verbal warnings, which did not require disclosure. Based on our arguments, the agency rescinded the proposed removal and returned our client to her job.
