OFO Appeal No. 0120152757
Our client filed an EEO complaint alleging disability discrimination and failure to accommodate. She alleged that the agency’s failure to provide reasonable accommodations led to her removal from the federal service. The agency issued a final agency decision (FAD), finding no discrimination. We appealed the FAD to the OFO. The OFO agreed with our arguments and held that the violated the Rehabilitation Act by denying our client reasonable accommodations. The OFO ordered the agency to reinstate our client to her former position, and awarded her back pay, compensatory damages, and attorney’s fees.
