Our client received a proposed removal for allegedly threatening his supervisor. During his nine-year federal career, our client had excellent performance ratings and no prior disciplinary record. However, he had filed several EEO complaints, alleging that his supervisor discriminated against him based on his national origin. We submitted a written response to the proposal, arguing that the agency was retaliating against our client for filing EEO complaints. The deciding official mitigated the proposed removal to a 14-day suspension.
