A U.S. Drug Enforcement Administration (DEA) federal employee with nearly 30 years of service retained us to respond to a proposed removal for false statements and conduct unbecoming. The agency alleged that our client failed to provide complete and truthful information about a family member’s legal issues. We submitted a written response and provided an oral reply, explaining that there was insufficient evidence to sustain the charges, that the issues were unrelated to the employee’s job duties, and that the agency failed to consider the special circumstances of the case. The deciding official reduced the penalty to a 14-day suspension.
