Our client worked for the Federal Aviation Administration (FAA). He supervised an employee who filed false time and attendance and travel records. As a result, the agency charged our client with “conduct unbecoming” and proposed to suspend him for 20 days. We argued that, as a second-line supervisor, our client was not responsible for the behavior of an employee two levels below. The deciding official mitigated the penalty to a 14-day suspension. After we filed a grievance, the agency rescinded the suspension altogether.
