Our client filed an EEO complaint against a previous supervisor at the Department of Health and Human Services and entered a settlement agreement with the Agency, which required the Agency to provide specific information to our client’s prospective employers. Our client made it to the final round of the interview process for a federal position, but did not get a job offer. Through a FOIA request, we discovered that the agency provided a negative reference, in violation of the settlement agreement. The EEOC Office of Federal Operations ruled that the agency retaliated against our client by giving her a negative job reference and awarded damages.
