The Department of Defense Consolidated Adjudications Facility (DoD CAF) issued our client a notice of intent to revoke his security clearance under Guideline E: Personal Conduct. The Statement of Reasons included a laundry list of alleged misconduct that occurred over a 20-year time period.
We submitted a written response that identified inconsistencies in the government’s evidence against our client. Many of the charges occurred 10 to 20 years ago, and the remaining charges allegedly occurred during the client’s prior employment with a different federal agency. Finally, we emphasized that the client held a clearance for his work with the Air Force, where he had an exemplary record. We submitted multiple statements from colleagues regarding the client’s good conduct and dedicated service.
The Air Force agreed with our arguments and decided not to revoke the client’s clearance.
