The U.S. Marshals Service issued our client a proposed suspension for allegedly “directing profanity and a slur at an employee.” In response, we showed that the agency failed to present evidence that the profanity was specifically directed at any employee or that our client used a slur. We also identified significant mitigating factors, including our client’s valuable contributions, exemplary performance, and spotless disciplinary record. Based on our arguments, the agency rescinded the proposed suspension.
